improvements from commercial and residential developments.

repealing the dormant Child Support Enforcement Commission;
clarifying the duties of the Bureau for Child Support Enforcement
Commissioner with respect to the child support formula; allowing
the Tax Commissioner to supply names and addresses to the Bureau
for Child Support Enforcement for enforcement of support
obligations; allowing collection of overpayments to support
obligees from state tax refunds; eliminating the requirement that
parties receive annual statements; providing for consistency of
service of process; and making technical corrections.

and physician assistants may be monitored while they pursue
treatment and recovery for alcohol abuse, chemical dependency or
major mental illness; and voluntary enrollment without being
subject to disciplinary action if the person complies with the

the requirement that they obtain continuing education.

Senate Bill No. 590--A Bill to amend the Code of West
Virginia, 1931, as amended, by adding thereto a new section, designated §15-2B-15; and to amend and reenact §57-5-11 of said
code, all relating to requiring the appropriate governmental entity
to retain any biological material that is secured in the
investigation or prosecution of a criminal case for the period of
time that a defendant remains incarcerated in connection with that
case.

Senators Boley, Bailey, Barnes, Sypolt, Yoder, Deem, Hall,
Caruth, Guills, Sprouse, McKenzie and Edgell offered the following

Senate Concurrent Resolution No. 38--Urging the President of
the United States and Congress to repeal the Real ID Act of 2005.
Whereas, The federal Real ID Act of 2005 mandates an unfunded
national driver's license on the people of West Virginia; and
Whereas, Implementation of the Real ID Act would cost West
Virginia taxpayers approximately $65 million; and
Whereas, The Real ID Act national database will invite theft
of identity and invasion of privacy; and
Whereas, The Real ID Act will impose inconveniences and higher
taxes on West Virginians with no attendant benefit such as
protection from terrorism; therefore, be it
Resolved by the Legislature of West Virginia:
That the Legislature hereby urges the President of the United
States and Congress to repeal the Real ID Act of 2005; and, be it
Further Resolved, That the Clerk is hereby directed to forward a copy of this resolution to the President of the United States,
the Secretary of Homeland Security, the Governor of West Virginia,
the President of the United States Senate, the Speaker of the
United States House of Representatives and each member of West
Virginia's congressional delegation.

responsibility to the children of West Virginia and its commitment
